Cyber Security & Privacy Liability

What do we cover?

Damages, including liability Assumed under contract & related Defense Costs arising from the above.

Liability costs incurred by covered insured resulting from a breach.

What is Security and Privacy Liability?

  • Failure to prevent or hinder a Security Breach, which in turn results in a Privacy Breach.

  • Failure to timely disclose a Security or Privacy Breach.

  • Failure to prevent the transmission of malicious code or computer virus from an Insured Computer to a Third Party.

  • Failure to prevent or hinder participation by an Insured in a Denial of Service Attack directed against the Internet Site or Computer System of a third Party.

Cyber Breach Events

What do we cover?

Notification Expense fees, including Legal Expenses, Forensic Investigation Expenses, Printing Costs, Mailing, and postage expenses that the Insured incurs to notify affected individuals & Breach Support & Credit monitoring Expense costs an Insured incurs to provide support to parties affected by a Privacy Breach.

Costs incurred by covered insured in responding to a breach that effects other individuals.

What are Breach Events?

  • Unauthorized collection, disclosure, use, access, or destruction of Private Information

  • Theft of Private Information

  • Infringement or Violation of any rights to Privacy

  • Hacking Attack

  • Loss of Insured’s Unsecured Data

Data Recovery

What do we cover?

Reasonable costs that the Insured incurs to replace, recreate, or restore Digital Assets to the same state and with the same contents immediately before they were damaged, destroyed, altered, stolen, etc…

Direct Insured Loss ($100k Sublimit)

What is Data Recovery?

Machine-readable information including but not limited to programs, applications, account information, customer information, health and medical information as well as computer programs that exist in an Insured Computer System. Does not include Computer Hardware.

Cyber Ransomware and Extortion

What do we cover?

Reasonable costs to retain or hire a Third Party specializing in IT Security to determine the validity & severity of a Threat & Money, digital currency, or other property that an Insured pays to any person or group reasonably believed to be responsible for a Cyber Extortion Threat to prevent or terminate such threat.

Direct Insured loss

What is Cyber Extortion?

Credible Threat or series of credit threats, including a demand for money which is directed at an Insured to:

  • Steal, alter, release, reveal, divulge, disseminate, destroy, publicly disclose, or misuse Private Information taken from an Insured through unauthorized access to, or unauthorized use of, an Insured Computer System.

  • Infect an Insured Computer System with malicious code or ransomware;

  • Corrupt, damage, or destroy an Insured Computer.

  • Restrict or hinder access to an Insured Computer, including the threat of a Denial of Service Attack.

  • Perpetrate or carry out a Phishing Attack; or steal, alter, release, reveal, divulge, disseminate, destroy, publicly disclose, or misuse an Insured’s confidential or proprietary information or Personally Identifiable Information.

What do we cover?

Direct loss of Money, Securities, or Cryptocurrency that an Insured sustains from the above. Crypto is sub-limited to $100k.

Direct Insured loss

What is Cyber Crime?

  • Intentional, unauthorized & fraudulent written, electronic, or telephonic instruction transmitted to a Financial Institution directing them to debit, transfer, withdraw, or disburse Money or Securities from a Covered Bank Account which instruction purports to have been transmitted by an Insured or Account Manager (but was in fact transmitted by a Third Party without consent)

  • A Phishing Attack directed at an Insured that fraudulently induces the Insured or Account Manager to transfer, pay, or deliver Money or Securities from a Covered Bank Account

    • Phishing Attack – an Attack by a third party where they fraudulently & intentionally use misleading Telephone calls, emails, texts, Instant messages, or other electronic communications to impersonate a legitimate or trustworthy contact, organization, or person.

  • Theft of Money or Securities from a Covered Bank Account or an Insured Personal Credit Card as a result of a Hacking Attack

Identity Theft

What do we cover?

Reasonable fees of an Attorney to

  • Defense Lawsuits brought against the Insured by Merchants, Financial Institutions, or collection agencies.

  • Remove civil judgments wrongly entered against the Insured.

  • Challenge the accuracy or completeness of information in a consumer credit report

  • Release medical records in cases of medical identity fraud.

  • Context a tax liability wrongfully incurred by the Insured.

  • Contest the wrongful transfer of ownership of Tangible Property

Reasonable costs to obtain Credit Reports or reasonable costs to monitor the Insured’s Credit for up to 24 months.

Direct Insured loss

What is Identity Theft?

Act of knowingly transferring or using, without lawful authority, a means of an Insured’s personal identity with the intent to commit a crime or aid or abet another to commit a crime. Includes Fraudulent use to establish Credit Accounts, Secure Loans, or enter into contracts. Also includes fraudulent use of Health Insurance numbers to file false claims or seek medical treatment, prescription drugs, or other medical care.

Cyberbullying and Counseling

What do we cover?

  • Reasonable charges for a therapist

  • Reasonable childcare or caregiver expenses

  • Reasonable expenses to temporarily locate.

  • Reasonable fees to retain a Digital Forensic analyst or Professional Cyber Security Consultant

  • If a Minor: Reasonable temporary private tutoring expenses, unreimbursed tuition, or increase in tuition to relocate a Minor.

Direct Insured loss (Capped at $50k)

What is Cyberbullying?

A series of two or more willful & repeated or continuing acts of harassment or intimidation, including embarrassment, defamation of character, slander, and threats of violence committed by electronic device. Include Texting, Instant messaging, Chat Rooms, Messages, Photos, & other content posted on social media sites
